Individuals who wish to utilize CKYBooks.com must read and agree to the following agreement and terms of service. By clicking on the check box above and completing the registration process you are stating that you have read and are in agreement with the Terms of Service (ToS) and Conditions of Use Below.
STATEMENT OF OWNERSHIP
By registering on our site and creating an order you are representing you have full legal rights to the items you are selling to CKY Books.
CKY Book’s AUTOMTED OFFERING SYSTEM
Our automated offering system is designed to help individuals sell their used items quickly at anytime of the day. The offers that are made are accurate 99.9% of the time. However with over 7 million titles in our catalog there are certain items where the offer amount may be computed incorrectly. If an offer has been made in error CKY Books will notify you of the error and your item will be returned to you at our expense.
CONDITION OF MERCHANDISE
All books must be in good used condition or better.
CKY Books will be solely responsible for the determination of the condition, type, and quantity of each book that was received. CKY Books reserves the right to adjust any prior offer based upon condition, type, or the number of books that were received.
Ex-Library or Institutional Copies
CKY Books, WILL purchase books of this type. Please note that books of this type will be purchased at a discounted price. If the books sent do not have any other issue then they are generally paid at 70% of the full offer price. (A good consumer copy that we offer $10.00 for, will only be paid a maximum of $7.00 for a library copy – providing it has no other issues). Please note that ex-library books make up our largest class of rejected items. We deal with many libraries and friends of the library groups around the country so please email us with any questions regarding our policies on these item.
UNACCEPTABLE CONDITIONS
- CKY Books WILL NOT accept books with the following physical/visual defects:
- Water damage/Moisture damage from any liquid – even minimal damage of this type is unacceptable
- Staining of any sort
- Missing /Loose / Torn Pages or Covers
- Books with an odor (smoke, musty, etc.)
- Workbooks/Activity Books/Manuals with answers written in the blanks or exercises worked
- Torn/Loose/Broken Binding
- Excessive Highlighting or Underlining
- Chewed on by a dog, cat, etc.
- Missing Dust Jackets – are subject to a lesser payment amount
UNACCEPTABLE ITEM TYPES
Also, CKY Books WILL NOT purchase the following types of books even though our system may make an offer on them:
- Dated Items – Day Planners, Calendars, Code Guides that are expiring shortly (Don’t try to sell us a calendar for 2009 in December of 2009)
- Advanced Reading Copies
- Uncorrected Proofs
- Galley copies
- Instructor or Teacher’s editions of textbooks
- Foreign/International Edition Textbooks
- Teacher/Student Solutions or Answers Manuals or Keys
- Reader’s Digest Books
- Books without an ISBN
- Magazines
- Encyclopedia sets
- Partial Sets or sets with missing volumes
- Pornography
- Books with front cover torn to indicate disposal
- Any books marked “not for resale”
- Bind in Cards/OLC/Online Access Items that are OPENED
- Recopied Media
CKY Books automated offering system is unable to flag the book types above, so it is possible offers may be made for them even though we will not purchase them. It is your responsibility to understand the types of books we are not permitted to purchase. Any questions on book types that we will not purchase can be sent to CKY Books, 500 John C. RETURN OF MERCHANDISE
Should CKY Books reject any item that does not meet our guidelines; we will notify you of what items were rejected, and the reason, by email. We will hold these rejected items for 14 days. We will be glad to return the item/s to you after receiving payment for the cost of return shipping. The customer shall bear the responsibility for all return shipping costs and insurance or tracking information if so desired. After 14 days, if your item/s are not claimed, they will be recycled without further communication.
CKY Books reserves the right to reduce the payment amount of any books sent that do not meet the condition/criteria guidelines; we will notify you of what books were adjusted and the reason. Notification will be sent to you by email.
SHIPMENT LOSS / DAMAGE
CKY Books is not responsible for books lost or damaged in transit to our warehouse. While CKY Books provides free shipping for incoming shipments, this is not an assurance of delivery. Any loss or damage to your item or shipment is between you and the carrier. CKY Books highly suggests insurance and tracking for all shipments at your own expense to protect yourself from loss or damage. No payment will be issued for books/shipments that do not arrive.
ELECTRONIC COMMUNICATIONS
When you visit CKYBooks.com or send e-mails to us, you are communicating with us electronically. You consent to receive communications from us electronically. We will communicate with you by e-mail or by posting notices on this site. You agree that all agreements, notices, disclosures and other communications that we provide to you electronically satisfy any legal requirement that such communications be in writing.
CKY Books may from time to time contact your via email, phone, or postal letter concerning your orders. All information contained in those emails, phone conversations or letters is considered confidential information. Reproduction in full or in part of any email, phone conversation, letter or any other correspondence without express written permission of CKY Books is prohibited.
YOUR ACCOUNT
If you use this site, CKYBooks.com, you are responsible for maintaining the confidentiality of your account and password, and for restricting access to your account, and you agree to accept responsibility for all activities that occur under your account or password. If you are under 18, you may use CKYBooks.com only with involvement of a parent or guardian. CKY Books reserves the right to refuse service, terminate accounts, remove or edit content, or cancel orders at their sole discretion.
CKY Books will not sell, lease, or otherwise disseminate your personal information.
CKY Books, in the event that any offer is made in error, will return those item/s to the customer at the expense of CKY Books, provided that all other CKY Books Policies, Conditions and ToS have been complied with.
CKY Books customers who have high order defect rates may have their accounts suspended or banned.
SITE ABUSE
CKY Books will not tolerate attempts to misuse or abuse the website CKYBooks.com. This includes but is not limited to creating multiple orders to sell the same title, circumventing quantity thresholds, creating multiple accounts, selling items that you have no legal right to, using the website in any malicious way to defraud, commit theft or cause damage to CKY Books or any third party. CKY Books will cooperate fully with any law enforcement agency or postal agency to assist in the prosecution of wrongdoing.
Termination
You agree that CKY Books may, without prior notice, immediately terminate, limit your access to or suspend your account, and access to the CKY Books Services. Cause for such termination, limitation of access or suspension shall include, but not be limited to, (a) breaches or violations of the TOS or other incorporated agreements or site guidelines/policies, (b) requests by law enforcement or other government agencies, (c) unexpected technical or security issues or problems, (d) extended periods of inactivity, (e) engagement by you in fraudulent or illegal activities. Further, you agree that all terminations, limitations of access and suspensions for cause shall be made in CKY Books sole discretion and that CKY Books shall not be liable to you or any third party for any termination of your account, any associated loss of revenue or unforeseen fallout from termination of our services.
Termination of your CKY Books account includes any or all of the following: (a) removal of access to all or part of the offerings within the CKY Books Services, (b) deletion of your password and all related information, files and content associated with or inside your account (or any part thereof), and (c) barring of further use of all or part of the CKY Books services.
Account Types
You agree that CKY Books, reserves the right to change your account type at our sole discretion based on your account activity and order history.CKY Books user accounts fall under certain classifications, “Consumer” and “Commercial” being the two most common account types.
Dealers and Commercial Accounts
If your account has been flagged as a “commercial” account it is possible that you will see different pricing or offer amounts, differences in allowable quantities, longer processing times and other operational differences that a CKY “consumer” account might not see.

CKY Books makes absolutely no representations or warranties, and expressly disclaims all representations and warranties, of any kind, implied or expressed, with respect to this web site or the information, the materials, the content, the services or the products included in this site.
